Are you aware of the changes introduced by The Sentencing Act 2026 in relation to the management of offenders after sentencing. A new custody "Progression Model" introduced for most offenders,
First, 1/3rd of sentence In custody. Second, 1/3rd of sentence with Intensive community supervision. Third, 1/3rd of sentence subject to licence conditions.
Standard Determinate Sentences (SDS) with automatic release currently at 40% or 50% maybe released after the first 1/3rd point. Bad behaviour in prison custody could increase additional days to be served.
Some offenders serving SDS sentences with automatic release currently at 67% may benefit from release at the 50% point. Specific offence(s) and sentence details will be relevant to assessing eligibility.
Fixed Term Recall (FTR 56) now introduced applies to Most SDS offenders limiting recall back to custody to 56 days before re-release. (Excludes some MAPPA and High Risk Offenders) Existing 14, 28 day and Standard Recall now replaced.
